These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and nuBuddy ("we," "us," or "our") regarding your use of the nuBuddy platform, including all features, services, and content available through our website and mobile applications.

2. Description of Service

nuBuddy is an AI-powered career development and interview preparation platform that provides:

• AI-based interview practice and assessment
• CV analysis and improvement recommendations
• Aptitude testing and skills assessment
• Group discussion simulations
• Career coaching and guidance
• Progress tracking and performance analytics

3. User Eligibility

3.1 Age Requirement

You must be at least 16 years old to use nuBuddy. By using this service, you represent and warrant that you meet this age requirement.

3.2 Account Types

• Candidates: Students or job seekers using the platform for interview practice and skill development
• Institute Admins: Educational institution administrators managing candidate access
• Company Admins: System administrators managing institute subscriptions

4. Account Registration and Security

4.1 Account Creation

• Candidate accounts are created by institute administrators
• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your password
• One active session per user is enforced for security

4.2 Account Responsibilities

• You are solely responsible for all activities under your account
• Notify us immediately of any unauthorized access
• Do not share your account credentials with others
• Do not create multiple accounts for the same person

5. Acceptable Use Policy

5.1 Permitted Uses

You may use nuBuddy for:

• Interview practice and career development
• Skills assessment and improvement
• Educational and professional growth purposes
• Legitimate career preparation activities

5.2 Prohibited Activities

You agree NOT to:

• Use the service for any illegal or unauthorized purpose
• Attempt to circumvent security measures or authentication systems
• Reverse engineer, decompile, or disassemble any part of the platform
• Upload malicious code, viruses, or harmful content
• Scrape, data mine, or harvest data from the platform
• Impersonate another person or entity
• Share interview questions or AI-generated content externally without permission
• Use automated systems (bots, scripts) to access the service
• Abuse or harass other users or staff
• Violate any applicable laws or regulations

6. Credit System and Billing

6.1 Institute Subscription

• Institutes subscribe to nuBuddy and allocate credits to candidates
• Each module (Interview, Aptitude, etc.) consumes credits per use
• Credit allocations are determined by your institute

6.2 Credit Purchases

• Candidates may purchase additional credits through Razorpay
• Credit packs are configured by institutes or available as standard options
• All payments are processed securely through Razorpay
• Credits are non-refundable once purchased

6.3 Refund Policy

• Credits: Non-refundable after purchase
• Technical Issues: If service is unavailable due to our fault, credits may be restored
• Institute Subscriptions: Refund policies determined by institute agreements

7. Intellectual Property Rights

7.1 Our Intellectual Property

All content, features, and functionality of nuBuddy, including:

• Software code, algorithms, and AI models
• Interview questions and assessment frameworks
• Logos, trademarks, and branding
• User interface design and layout
• Reports, analysis, and generated content

are owned by nuBuddy and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

• You retain ownership of content you upload (CVs, responses, etc.)
• You grant us a license to process your content for service delivery
• We will not use your content for purposes beyond providing the service
• You are responsible for ensuring you have rights to upload any content

8. AI-Generated Content and Accuracy

8.1 No Guarantees

• Interview feedback is for practice purposes only
• AI assessments do not guarantee real-world job performance
• Users should use their own judgment and seek professional advice
• nuBuddy is not a substitute for professional career counseling

8.2 User Responsibility

You acknowledge that:

• AI feedback is advisory, not definitive
• Real interview outcomes may differ from practice sessions
• You are responsible for your own career decisions

9. Data Privacy and Security

Your use of nuBuddy is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. Key points:

• Audio recordings are automatically deleted after processing
• Data sent to AI providers includes instructions against training use
• You can request account and data deletion at any time
• We use 256-bit encryption and industry-standard security

10. Service Availability and Modifications

10.1 Service Availability

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• We are not liable for temporary unavailability or performance issues

10.2 Right to Modify

We reserve the right to:

• Modify, suspend, or discontinue any feature at any time
• Change pricing for new purchases (existing subscriptions honored)
• Update these Terms of Service with notice to users
• Improve or enhance the service based on user feedback

11. Termination

11.1 By You

• You may request account deletion at any time
• Contact your institute admin or support@nubuddy.com
• Unused credits are forfeited upon account closure

11.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or abusive behavior
• Compromise the security or integrity of the platform
• Fail to pay for purchased credits (after reasonable notice)

12. Disclaimers and Limitations of Liability

12.1 Service "As Is"

nuBuddy is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Accuracy, reliability, or completeness of content
• Fitness for a particular purpose
• Merchantability or non-infringement
• Uninterrupted or error-free operation

12.2 Limitation of Liability

To the maximum extent permitted by law, nuBuddy shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from use or inability to use the service
• Reliance on AI-generated content or recommendations
• Third-party actions or content

Maximum Liability: Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless nuBuddy, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or submit

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

14.2 Dispute Resolution

• Informal Resolution: Contact us at support@nubuddy.com to resolve disputes informally
• Arbitration: Unresolved disputes shall be settled through binding arbitration in accordance with Indian Arbitration and Conciliation Act
• Jurisdiction: Courts of Mumbai, Maharashtra, India shall have exclusive jurisdiction

15. Third-Party Services

nuBuddy integrates with third-party services:

• OpenAI: For AI interview analysis and transcription
• Razorpay: For payment processing
• SendGrid: For email delivery

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service failures or changes.

16. Changes to Terms

We may update these Terms periodically. Changes will be:

• Posted on this page with updated "Last Updated" date
• Notified via email for material changes
• Effective 7 days after posting (unless urgent security updates)

Continued use of nuBuddy after changes constitutes acceptance of revised Terms.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and nuBuddy regarding use of the service.
